Compensation claim
Thousands of people are injured every year at work, in public areas and
in traffic accidents, while many of these injuries are minor some are severe
and require hospital treatment and may leave permanent physical damage.
Compensation Claims:
In many of these cases resulting in personal injury, the cause can be traced
to a person’s or organisation’s negligence, in these cases the
injured party can claim compensation. Claims for compensation come under
two headings – specific and general, and you will generally be awarded
a compensation amount under both of these if your claim is successful.
Specific compensation
This covers areas where the costs to the injured party can be definitively
proven, such as the cost of damage to property, loss of earnings, travel
costs to receive medical treatment. For example, in you are in a car accident
you will be able to claim the cost of repair to your car, the cost of replacing
clothing that was damaged, car rental charges due to not having your own
car available to use etc.
General compensation
This is used to describe the less easily quantifiable losses, and covers
the areas of pain and suffering, and the potential future problems that
may arise from your injuries. It takes into account future loss of earnings,
and other such areas.
When seeking compensation, the majority of people will appoint a solicitor
to pursue the claim on their behalf, many solicitors will operate on the
‘no win no fee’ basis, which means that if your compensation
claim is not successful you will not be left with any legal costs to pay.
If your claim does succeed, then the solicitor will be paid through the
legal expenses that the defendant will be instructed to pay by the court.
Being injured in an accident can cost the injured party a great deal of
money in lost earnings and loss or damage to their property, a compensation
claim can cover these costs and ease the person’s recovery, find
